 Cittadini, associazioni e attivisti hanno sfidato un colosso come ENI e le istituzioni che lo sostengono: sembrava una lotta impari,ma hanno vinto, ottenendo dalla Cassazione l’ammissione del loro ricorso.

Viene riconosciuta la giurisdizione dell’autorità giudiziaria italiana che ora dovrà esprimersi nel merito, come già avviene in altri paesi europei.Le Sezioni Unite della Cassazione hanno stabilito che anche in Italia si possono istruire le cause climatiche. Lo storico pronunciamento della Suprema Corte, che come è risaputo fa giurisprudenza, ha confermato che spetta al giudice civile decidere sui danni ai diritti umani provocati dalle emissioni climalteranti delle aziende fossili.

La Sentenza fa riferimento a comportamenti e scelte di ENI che contrastano con l’Accordo di Parigi entrato in vigore il 4 novembre 2016, dopo l’adempimento della condizione di una sua ratifica da parte di almeno 55 paesi che rappresentassero almeno il 55% delle emissioni globali di gas a effetto serra.

Ma la Sentenza è storica anche perché è espressione dalla corretta interpretazione dei propri ruoli da parte della Politica e della Magistratura.

La politica fa le leggi in difesa dei cittadini e delle risorse comuni, ma se poi tali leggi non vengono rispettate procurando danni all’ambiente e/o ai cittadini è compito della Magistratura intervenire per punire i trasgressori.

Si entra così in una storica ambiguità circa le leggi e le norme ed il fatto che possono essere le più belle del mondo ma se non vengono rispettate sono assolutamente inutili. In questo caso il mancato rispetto riguarda come detto, l’accordo di Parigi per un impegno che mantenga entro 2 gradi l’innalzamento della temperatura media del Pianeta rispetto all’era preindustriale.

Le Sezioni Unite civili hanno così accolto il ricorso per regolamento di giurisdizione presentato da Greenpeace Italia, ReCommon e 12 cittadine e cittadine che nel maggio del 2023 avevano avviato una causa, da loro ribattezzata la “Giusta Causa”,* contro il gigante petrolifero italiano ENI affinché sia imposto alla società di rispettare l’Accordo di Parigi. In punta di diritto.

È stato così escluso che nella materia possa essere invocato un “difetto assoluto di giurisdizione”, nel senso che nessun giudice italiano avrebbe potuto decidere sulle cause climatiche, come obiettavano ENI e i suoi azionisti di maggioranza relativa.
